Concessions: new package, new rules

Last March, the Federal Government announced a package of 55 concessions that will integrate the portfolio of the Program of Partnership in Investments (PPI). One of the main news of this package is the solution found to overcome a deadlock that was going on through at least two years: the authorization for new investments in already-conceded roads. The plan brings also the possibility of anticipating the end of the current contracts.

Current concessionaires want to carry out works not forecasted in the contracts. For this reason, they asked for an anticipated renewal of them that could include the improvements. This measure was not accepted by the Federal Court of Auditors (TCU) because the original contracts did not foresee any possibility of renewal.

To prevent this deadlock, the government will propose the anticipated re-bidding of the contract. In other words, the current contracts may be terminated before its expiration date. The way to manage this situation was not already defined. Its intention is to start the studies to decide how this solution would be implemented in three concessions: Nova Dutra, Rio-Teresópolis (CRT) and Rio-Juiz de Fora (Concer).

The current concessionaire will be indemnified due to the anticipated termination of its contract. But the studies may recommend the use of rules that will ease it to win the new bid.

Last September, the first set of concessions of the PPI was presented. It included 35 projects in the areas of airports, ports, roads, railways, oil & gas, mining, energy and sanitation. Since then three contracts were signed and seven public notices of concession and leasing were published. Till the end of this year more than 20 auctions are foreseen as part of the PPI.
